The idiom here is "one of the x" which always takes a [lural form. eg one of the values of the equation, "one of the most corrupt ministers" which is analogous to the superlative form in which the setence is quoted.

I found an explanation to this question in one of the Manhattan GMAT Forum Discussions(I have pasted the explanation given by an MGMAT staff below):-
" There IS a crucial difference between "rather than" and "instead of" that you should know. "Rather than" is a conjunction and so can be followed by basically anything, whereas "instead of" is a (complex) preposition -- and a preposition should be followed only by a noun.
Now, the noun can be an "-ing" verb, known as a gerund. So, the sentences you quote are not grammatically wrong in this regard. However, the GMAT seems to prefer "rather than" in comparisons of verbs, because the parallelism is clearest:
(1) "I ski rather than snowboard." -- Correct. (2) "I ski instead of snowboarding." -- Correct, but a 'little' less parallel, so (1) is slightly preferable. The GMAT probably won't test this point in isolation, though, so we're going to revise the question.
You can also use "rather than" to compare phrases or clauses. In that context, "instead of" is absolutely wrong, even though it's heard in spoken English: (3) "I went in the cellar rather than in the attic." -- Correct. (4) "I went in the cellar instead of in the attic." -- INCORRECT although this 'sounds' normal to me, to be honest! (That's why you have to retrain your ear -- it's not always grammatically right!) I will go with D. Its more of a "meaning" question. The automobile company agrees to pay civil damages because it had circumvented the testing regulations by disconnecting odometers of the cars that were tested. Now the $16 million will not be awarded to only the cars that were tested, but will be given as civil damage. So as choice (D) states - the automobile company will pay damages as it is guilty of the following "having test-driven cars with their odometers disconnected"

As arch pointed out "rather than" is prefered to "instead of" on the GMAT. esp when connecting clauses/phrases. Though there are other tricks to this question. a. "whether" is better than "if" b. "accepting" and "was sent" are not parallel. "whether" is better than "if" c. "accepting" and "sailed" violate parallelism d. sounds good.. "rather than" + whether + (accept and sailed are parallel) e. (accepting + was sent) , instesad of, (if vs whether)
