An essay/article (I don't know what should I call it) on Section 66A of IT Act, 2000:

The recent judgment of the Supreme Court in Shreya Singhal vs Union of India case that quashed the Section 66A of the Information Act, 2000 raises some important issues. Even as the law was seen by many as unconstitutional, there is still a need of laws that curb the menace that is spread online.

The Section 66A of the IT Act, 2000 says that any person who sends, by means of computer, any information that is "grossly offensive" or has "menacing character" is punishable. Even if one doesn't go into details of this section, one can guess the vagueness of this section which actually caught the eye of the H'ble Supreme Court.  Supreme Court in its judgment said that Section 66A is vague and arbitrary.
The terms "grossly offensive" and "menacing character" have no precise definition and there is no parameter on which one can judge if a statement was "grossly offensive" or of "menacing character".

Also, the Supreme Court observed that this Section actually violates the fundamental right of free speech. The article 19(1)(a) in the Part III of the Indian Constitution guarantees citizens a right to freedom of speech and expression. However, the article 19(2) in the same part limits the same right allowing the state to impose laws.

There are few cons of this ruling; first, we need some law to control the activities of people who are spreading hatred on the net. So, simply quashing an existing law which was "unconstitutional" will not help. Second, rather than simply striking of the law, the Supreme Court could have asked the Centre to remove the vagueness and present a law which could be defined in a way it doesn't sound "unconstitutional".

Pros of this judgment are many which have already been mentioned. To add one more, it will save people from the unnecessary action by police which has been one of the issues why this Section was actually in question.

This is however, a landmark judgment giving the citizens their fundamental right of speech and democracy. Not to forget, the legislation should come up with an alternative as early as possible.

1. Digital Infrastructure - The basic necessity for a strong digital infrastructure is a strong base, Internet.Government aims to provide high speed internet in every nook and corner of the country. As soon as the base is ready,our government will start building the structure of digital India by providing various basic services needed by the people such as,

a. Digital Identity- Unique lifelong Identity which'll be authenticable. b. Digital Banking - More emphasis on mobile and internet banking. c. Easy access to a Common Service Centre.                                       d. Shareable private space on a public cloud for saving important documents.

2. Governance and Services on Demand

Government services and products will be seamlessly integrated across departments and jurisdictions.All the services will be made real time from online and mobile platforms.For the corporates, services will be based on ease of doing business.Government will also be able to reduce the average the turn around time taken by authorities to address grievances.

3. Digital Empowerment of Citizens

Government aims to provide universal digital literacy so that no one is devoid of education.Books, novels, and other resources are to be made universally accessible. Keeping in mind that most of the needy citizens belong to rural areas where English or Hindi is not the primary mode of communication, the digital resources will be in respective regional languages as well.

As this initiative seems to have promising outcomes, it is equally difficult to achieve considering economic conditions of our country.Allthough,in near future,we might be able to see poor children speaking fluent english, government turn around time shortening to days from weeks,and overall a better nation.
