Essay : Land Acquisition Bill 2015.


Development is crucial for a developing country like India. The first and foremost requirement for development in a country is Land acquisition. For setting up factories to manufacture goods, urbanization of villages we need to acquire land.

Currently India ranks 142 in ease of doing business which indicates foreign investor are not willing to invest in our country and that may pose hindrance in the process of development. So to ease the process of doing business in our country, our government came up with the Land Acquisition Bill(LAB).

Before the introduction of this bill, in 2013 UPA government replaced the "Land Acquisition Act, 1894 with "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013". This act made land acquisition almost impossible leaving both investors as well as land owners frowning. Therefore, NDA government came up with Land Acquisition bill 2015 and it is due in parliament for approval.

Pros of LAB 2015

1. Acquisition time has been significantly reduced as Social Impact Assessment has been removed for 5 sectors.

2. There were certain areas for which no fixed criteria to give compensation to land owners was decided. Those areas are being addressed in this new bill.

3. Bill includes acquisition of land for private hospitals as well as private educational institutions. So land owners can expect better compensation.

4. If the acquired land is left unutilized for 5 years or any arbitrary period of time mentioned at the time of acquisition, it will be returned to land owners after the specified period of time or 5 years, whichever may be the case. So it provides investors flexibility to carve different business strategies.

Cons of LAB 2015

1. The Social Impact Assessment has been removed for 5 sectors which makes it easier to acquire the land without the mandatory consent percentage of land owners. Previously it was 80% in case land is acquired for national security, defence, rural infrastructure and 70% for Public Private Partnership projects.

2. The country may face food security problems as irrigated multi-crop lands are also allowed to acquire in this bill.

3. As the bill allows investors to mention arbitrary time period at the time of acquisition, we are dependent on the intentions of investors whether they'll make good use of it or will leave it unutilized.

For the development of our country land acquisition is a requirement. As SIA will let land owners know what investors are going to do with their land, they will give their land willingly instead of hampering the development by agitations. Also, if not utilized, they'll get their lands back as well. It's a win-win situation for both the parties.
