Kannan Raghupathy 5 mins · Some job aspirants belonging to the OBCs brought to my notice last week about a lead story in a leading news daily in Bihar which said that OBCs will be considered against vacancies reserved for them only and not against General Vacancies even if they meet the cut off prescribed for general candidates. Let me state categorically right at the outset- the headline was misleading and incorrect though the news item itself was substantially correct. The DoPT OM of 1998 clearly says that those SC, ST and OBC candidates who meet the standards set for UR candidates will be considered against UR vacancies. If relaxed standards were applied to any such candidate he will be considered against a vacancy earmarked for his category. Tnis OM is still valid and will continue to be followed. To clarify further, if a OBC candidate had availed of relaxed standards at any stage of the examination he can be considered for a OBC vacancy only. He cannot lay claim to a UR vacancy even if he scores more than the final UR cut off. The Supreme Court judgment of early April, 2017 only said this and no more. The SC Bench of two judges cited the 1998 OM of DoPT and their order was based on this OM. In that case, a OBC candidate had availed age relaxation but her marks were more than the UR cut off and UR vacancies were available as no UR candidate met the UR cut off. It is, however, disputable whether age relaxation can be treated as relaxation in standards in view of orders of several HCs to the contrary. DoPT, the nodal department for personnel and recruitment and the Ministry of Social Justice, the nodal Ministry for reservations will have to decide whether they would like to move the Supreme Court for a clear decision in this regard. There is a mention in the SC's order in the instant case that they did not look at the vires or constitutional validity of the 1998 OM as the petition before them did not question the constitutionality of the OM. Therefore, the window is open to the Government to seek a decision in this regard. Even the petitioner in the case an avail this window. I very much doubt whether the Government will seek a decision in this regard.
