Heard Sri Prabhakar Awasthi, learned counsel for the petitioner and Sri Nisheeth Yadav, learned counsel representing respondents-U.P. Public Service Commission and also Examination Controller, Combined State Engineering Services Examination, 2011. By means of this writ petition under Article 226 of the Constitution, the petitioner has prayed for issuance of writ of mandamus commanding the respondents to forthwith accommodate/appoint the petitioner on one of the post amongst two posts which remained vacant in the category of Scheduled Caste and further prayer is that the respondents be directed to disclose before this Court, the manner in which the merit list was prepared. Counter affidavit and rejoinder affidavit have been exchanged. We have perused the pleadings of both the parties. In addition, pursuant to our order dated 17.02.2017, learned counsel for the respondents has also placed further instructions received from the Commission. The Commission issued an advertisement dated 10.12.2011 by the name of Combined State Engineering Services Examination, 2011, inviting applications for the post of Assistant Engineer in different departments and in different disciplines and also for two posts each of Assistant Director (Factories and Boiler) and Labour Department. The petitioner admits of the eligibility to apply against the post of Assistant Engineer (Mechanical) in Irrigation Department and also for the post of Assistant Engineer (Electrical/Mechanical) in Public Works Department (P.W.D.). The petitioner belongs to Scheduled Caste category. In the Irrigation Department, out of total 16 posts for the Mechanical Discipline advertised, 05 posts were reserved for Scheduled Caste candidates whereas in the Public Works Department out of 11 posts advertised for Assistant Engineer (Electrical/Mechanical), 03 posts were reserved for Scheduled Caste candidates. Written examination was held in April, 2013 and thereafter, result was declared on 20.05.2016. The petitioner bearing Roll No.3288 was found selected in the written examination for the post of Assistant Engineer (Mechanical) in the department of Irrigation as also for Assistant Director (Boiler) in the Labour Department. However, considering the fact that the petitioner did not possess two years' of work experience, which was essential qualification for the Assistant Director (Boiler), he was not considered for the same but was only considered for the Assistant Engineer (Mechanical) in the Irrigation Department. Interviews were held in the month of June, 2016 in which the petitioner appeared and thereafter the final results were declared. The petitioner was not selected. A press note was issued on 04.07.2016 by the Commission in which it was mentioned that two posts for Scheduled Caste for the post of Assistant Engineer (Electrical/Mechanical) have been carried forward as suitable candidates were not available. At that stage, he approached this Court and claimed that he be accommodated against the two posts left vacant and were carried forward in the Public Works Department. We have gone through the petition and we find that the petitioner has sought to set up a case to the effect that the word 'preference' used in the advertisement will be considered for the respective posts at the time of interview would mean that a common select list ought to have been prepared after the written examination. Some grounds have also been taken to the effect that there has been highhandedness of the Commission as the period of 05 years lapsed between the publishing of advertisement and declaring the result, therefore, manipulation and maneuvering cannot be ruled out. Sri Awasthi, learned counsel for the petitioner has vehemently submitted that the segregation of the department wise list of successful candidates in the written examination was a faulty procedure adopted by the Commission. His submission is that once the advertisement was issued for Combined State Engineer Services Examination then a combined result should be declared after the written examination and thereafter at the stage of interview after taking preferences, the final result should be declared, placing the selected candidates depending upon their merits, in the different departments as per their preferences. In reply, Sri Nisheeth Yadav, learned counsel for the respondents submitted that the Commission has received requisition from different departments, separately which also identifying the number of posts for the Unreserved Category, Scheduled Castes, Scheduled Tribes and Other Backward Classes. He also submitted that the horizontal reservation of 20% for women has also to be applied department wise and accordingly the result of the written examination was declared. Department wise cut off marks have been fixed for different departments separately. For the post of Assistant Engineer (Electrical/Mechanical) in the Public Works Department, the minimum cut off marks for the Scheduled Caste category was 387.74 whereas for the Assistant Engineer (Mechanical) in the department of Irrigation the minimum cut off marks was 343.95 which actually the petitioner has secured and as such he was the last candidate to be called for interview for that department. He also placed before us the list of cut off marks which shows that the maximum marks obtained for both the categories was 448.53 and as there were different numbers of vacant posts in the Scheduled Caste category in two departments, the minimum cut off marks accordingly being achieved for Public Works Department, it was 387.74 whereas it was 343.95 for the Irrigation Department was fixed. Sri Yadav, learned counsel for the respondents further stated that the candidates who secured the highest marks and were successful in the written examination for both the departments were called for interview for each of the departments in which they had qualified. It was only at the stage of interview after taking their preferences, the department would be allotted in the final merit list. It is for this reason that the word 'preference' was to be applied at the time of interview for the candidates who have been successful in the written examination for more than one department. Having considered the submissions, we find that the Commission has followed a pattern for the selection which does not cause any prejudice to the petitioner or any other candidate who has not been selected, therefore, we do not find any merit in this petition. Writ petition is, accordingly, dismissed.
