yaar, am little sceptical about both the options, but here are my 2 cents:
From A, it is not clear if resembling goes with fossils or creature !
so A seems wrong.

From B, resembles is modifying creature and seems to be right choice.
i would go for B !

MY question is - if you are stuck between two choices
1) with a participle and
2) with a modifier "which" ....

other things remaining the same, which of the above do you chose.

For eg: Consider the following example -

Hailed as a key discovery in the science of evolution, the fossils of a large scaly creature resembling both a fish and a land-animal provide evidence of a possible link in the evolutionary chain from water-based to land-based organisms.

a)the fossils of a large scaly creature resembling both a fish and a land-animal provide evidence of

b)the fossils of a large scaly creature, which resembles both a fish and a land-animal, provide evidence of

which of the options a,b will you chose and why?.

B. The act of Congress, which was approved April 24, 1800, making provision for the removal of the government of the United States to the new federal city, Washington, D.C., also established
little better but it sounds like the act was approved by making the provision. I will reject this one.

C. The act of Congress approved April 24, 1800, which made provision for the removal of the government of the United States to the new federal city, Washington, D.C., and established
which incorrectly refers to April 24, 1800
D. Approved April 24, 1800, making provision for the removal of the government of the United States to the new federal city, Washington, D.C., the act of Congress also established
not good to have two modifiers before the subject. it usually causes confusion.
E. Approved April 24, 1800, the act of Congress made provision for the removal of the government of the United States to the new federal city, Washington, D.C., also establishing
'also establishing" is a run on

My pick is A because....

A. Approved April 24, 1800, the act of Congress that made provision for the removal of the government of the United States to the new federal city, Washington, D.C., also established

** The phrase "Approved.." is correctly referring to "the act of congress" which has a construction - " The act of congress that made X also established Y".

B. The act of Congress, which was approved April 24, 1800, making provision for the removal of the government of the United States to the new federal city, Washington, D.C., also established
**"making" - using a continuous tense is not correct

C. The act of Congress approved April 24, 1800, which made provision for the removal of the government of the United States to the new federal city, Washington, D.C., and established

**"which" is wrongly referring to "April 24.." and also "and established" is awkward.

D. Approved April 24, 1800, making provision for the removal of the government of the United States to the new federal city, Washington, D.C., the act of Congress also established
**Same as B. also the phrase "approved.." is not referring correctly to the noun.

E. Approved April 24, 1800, the act of Congress made provision for the removal of the government of the United States to the new federal city, Washington, D.C., also establishing
**No need for continuous tense "establishing"
