Frankly speaking for the first one, I eliminated option (E) because it was sounding awkward to me. So I really don't have explanation for that.
For second one, let's look at the given sentence. The sentence has one subordinate clause and one main clause. Here, to join subordinate clause with main clause, that is required. Options in which that is omitted can be eliminated. So we are left with two options, (A) & (E). But if we go for (E), the sentence will have two main clauses. When there are two main clauses in sentence, the same have to be separated by a coma. But here it's not the case. Hence (E) can be eliminated. So (A) is the answer.

D2 (with have been) will be more appropriate if it were one of the choices. And probably that is the reason why it is not included as one of the choices :)
Be careful though. Amendment has been completed in 1972. It is a completed action. So, be wary of Simple tense usage.
Use present/past perfects only when needed. If you can do away with simple past/present, then it is more preferred. (Pages 130-132 Manhattan SC)

It was broken, just to add more complexity. Syntactically, there is nothing wrong with separating 'to be able' and 'to assess'.
